These terms govern your use of runprojectphoenix.com and the Phoenix Recon scanner. By using the service, you agree to them. If you do not agree, please do not use the service.
The service
Project Phoenix is a confidential AI strategy practice. The public-facing components include this website and the Phoenix Recon scanner. Formal engagements ("Phoenix Protocol") are governed by separately executed agreements between Project Phoenix and the engaging organization.
The Phoenix Recon scanner
The Recon scanner is provided for informational and educational purposes only. The disruption analysis it generates is produced by AI language models and represents one analytical perspective on a company's exposure to AI-driven change. It is not a prediction, a guarantee, professional advice, or an investment recommendation.
You should not make commercial, investment, hiring, or strategic decisions based solely on Recon output. We make no representation that the analysis is complete, current, or free of error.
By submitting a domain to the Recon scanner, you represent that you have a legitimate basis for requesting the analysis. Do not use the scanner to harass, defame, or target third parties.
Intake submissions are not offers
Submitting information through any intake or unlock form does not create a binding offer, contract, or obligation on either side. Project Phoenix reserves the right to decline any engagement for any reason, and to limit access to Phoenix Protocol engagements at its sole discretion.
Acceptable use
You agree not to:
- Use the service to harass, defame, intimidate, or target individuals or organizations.
- Submit fraudulent, misleading, or impersonating information.
- Scrape, automate, rate-limit-evade, or otherwise attempt to disrupt the service.
- Reverse-engineer the Recon analysis or attempt to extract underlying prompts, models, or methods.
- Use the service for any unlawful purpose or in violation of any third-party rights.
We may suspend or terminate access for any conduct we reasonably believe violates these terms.
Intellectual property
The Project Phoenix name, brand assets, design system, methodology, the Phoenix Blueprint, and the Phoenix Recon scanner are proprietary to Project Phoenix. You may not copy, modify, distribute, sublicense, or commercially exploit any of these without prior written permission.
You retain ownership of the content you submit. By submitting content, you grant us a limited, non-exclusive license to use it for the purpose of providing the service to you and operating our business.
Confidentiality
Active engagements operate under separately executed non-disclosure agreements. Communications outside of an active engagement are not automatically subject to confidentiality obligations on Project Phoenix's part. Do not send us information you consider confidential before an NDA is in place.
Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Project Phoenix disclaims all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law, Project Phoenix and its operator shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service, even if advised of the possibility of such damages.
The aggregate liability of Project Phoenix arising out of these terms or your use of the service shall not exceed one hundred United States dollars (USD $100).
Indemnification
You agree to indemnify, defend, and hold harmless Project Phoenix and its operator from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your misuse of the service, your violation of these terms, or your violation of any third-party right.
Governing law
These terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws principles. Any dispute arising from these terms or your use of the service shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.
Changes
We may revise these terms from time to time. The effective date at the top of this page will reflect the most recent revision. Your continued use of the service after changes become effective constitutes acceptance of the revised terms.
Severability and entire agreement
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force. These terms, together with the Privacy Policy and any separately executed engagement agreement, constitute the entire agreement between you and Project Phoenix concerning the service.
